PRIVATE BETA PROGRAM - PRIVACY STATEMENT

1. INTRODUCTION AND SCOPE
This Privacy Statement (this "Statement") is issued by KP-AI Inc ("KP-AI", the "Company", "we", or "us") and describes the Company’s practices regarding the collection, processing, disclosure, and retention of information in connection with the Company’s private, invitation-only beta website and program (the "Beta Program"). This Statement applies exclusively to the Beta Program. Capitalized terms not defined herein have the meanings ascribed to them in the Private Beta Terms and Conditions of Use.
2. CATEGORIES OF INFORMATION PROCESSED
2.1 Account information: name, business email address, employer, and professional role, as provided upon invitation or registration.
2.2 Uploaded Data: log files, telemetry, traces, and related materials submitted by the User for analysis.
2.3 Output: the analyses, findings, and reports generated by the Beta Service from Uploaded Data.
2.4 Feedback: evaluations, survey responses, and communications provided by the User.
2.5 Technical and usage data: server logs, device and browser metadata, IP addresses, and interaction records processed for security and service operation.
3. UPLOADED DATA; USER DISCRETION AND RESPONSIBILITY
3.1 All Uploaded Data is submitted solely at the User’s discretion. The Company does not direct, solicit, review, or verify the content of Uploaded Data prior to processing and assumes no responsibility whatsoever for such content or for any information contained therein.
3.2 The User is required to exclude, remove, redact, or anonymize personal data, special categories of personal data, credentials, secrets, and any information the User is not authorized to disclose, prior to upload, except where expressly authorized in writing by the Company.
3.3 To the extent Uploaded Data nevertheless contains personal data, the User warrants that it has a lawful basis for its disclosure, and the Company shall process such personal data solely as a processor acting on the User’s documented instructions, as set forth in this Statement and the Terms.
4. PURPOSES OF PROCESSING
4.1 Provision of the Beta Service: processing Uploaded Data to generate and deliver Output to the User.
4.2 Improvement and training: testing, evaluating, developing, improving, and training the Company’s platform, analytical engines, rulebooks, and models, using certain Uploaded Data, Output, and Feedback, in original, aggregated, or de-identified form, with preference given to aggregated or de-identified data where reasonably practicable.
4.3 Program administration and communications: onboarding, support, feedback solicitation, and notices regarding the Beta Program.
4.4 Security and compliance: access control, abuse prevention, audit logging, and compliance with legal obligations.
4.5 The Company does not sell personal information and does not process information for third-party advertising purposes.
5. LEGAL BASES FOR PROCESSING (EEA/UK)
Where Regulation (EU) 2016/679 or the UK GDPR applies, the Company relies on the following legal bases: (a) performance of a contract (Article 6(1)(b)) - operation of the Beta Program requested by the User; (b) legitimate interests (Article 6(1)(f)) - the improvement, development, and security of a pre-release product, balanced against the rights and freedoms of data subjects; and (c) consent (Article 6(1)(a)) where required by law, which may be withdrawn at any time with effect for the future.
6. DISCLOSURE OF INFORMATION
Information may be disclosed solely to: (a) service providers and subprocessors engaged in hosting, infrastructure, and support of the Beta Program, bound by written confidentiality and data-processing obligations; (b) professional advisers subject to duties of confidentiality; (c) competent authorities where disclosure is required by applicable law or legal process; and (d) a successor entity in connection with a merger, acquisition, or sale of assets, subject to this Statement. The Company does not sell or rent information to third parties.
7. RETENTION
Uploaded Data and Output are retained for the duration of the Beta Program and for a reasonable period thereafter for evaluation and improvement purposes, unless earlier deletion is requested by the User. Information incorporated into aggregated or de-identified datasets may be retained in such form without time limitation. Account information is retained for as long as necessary to administer the Beta Program and to comply with legal obligations.
8. SECURITY MEASURES
The Company implements technical and organizational measures appropriate to a pre-release environment, including encryption in transit, role-based access controls, and logical isolation of processing environments. The User acknowledges that no security measures are absolute and that the Beta Program is provided for evaluation purposes; the User remains responsible for the sensitivity of the data it elects to upload.
9. DATA SUBJECT AND USER RIGHTS
Subject to applicable law, the User (and, where applicable, data subjects) may request access to, rectification of, erasure of, or portability of personal data, and may object to or request restriction of certain processing. Requests shall be addressed to privacy@kp-ai.ai [confirm address] and will be handled within the timeframes prescribed by applicable law. Persons in the EEA or UK have the right to lodge a complaint with a competent supervisory authority.
10. INTERNATIONAL TRANSFERS
Information may be transferred to and processed in jurisdictions other than the User’s own. Where such transfers are subject to data protection law, the Company implements appropriate safeguards, including standard contractual clauses approved by the European Commission or the UK Information Commissioner’s Office, as applicable.
11. AMENDMENTS
The Company may amend this Statement from time to time. The then-current version, together with its effective date, will be posted on the Beta Website. Material amendments will be notified to registered Beta users. Continued participation in the Beta Program following such posting constitutes acknowledgment of the amended Statement.
